we all know that lalit modi is suspended and is served notice for which he has been given 15 days time to answer it... though i wonder they would even bother to take a glance at the reply...

coming back to the point... the charges have been framed... elaborated by bcci president... shashank manohar... explaining the 'irregularity' in initial bids for rajasthan royals and kings xi punjab... the part which catches the eye...

"There is a clause in the agreement, which is entered into with all the franchises, that in case you transfer your shares, the transfer has to be made with the permission of the IPL and the board is entitled to have 5% of the amount of the transaction as their fees. Now nothing of this [sort] has happened. So we are asking an explanation, if A gives the bid, how do you sign agreement with B? How does (sic) all these people get into this? None of us are aware and we don't know who these companies are."

even after trying hard... i could not make the sense out of it... both franchise documents were signed three years ago... so all these three years you were in deep slumber... and now you suddenly woke up and say we did not know... and punish the one who kept awake all this while...?

if this was not enough to prove your selective amnesia... i chanced upon another gem of yours...

The BCCI chief said Modi would informed about contracts after he had signed them on behalf of IPL and the other parties and the GC will have to pass them as there were no other alternatives.

"And they are brought before the Governing Council after the contracts are signed. So the Governing Council has no other option and are presented with a fait accompli," Manohar said while explaining about the murky deals that have come under the scanner of the Income Tax and Enforcement Directorate departments.

err... wait a minute... did you just said all contracts used to come to you pre-signed and you (and GC) had no alternative but to sign them...? even if we believe it for a moment for the sake of argument... then how you would explain it with your your charges on modi that you (and gc) were not aware of any contracts or dealings done by him...?

do you really want us to take this bullshit as lollipop which will not only keep us busy but also keep our mouth shut sucking it...?

So it does look that u r a rank idiot. I am not surprised that even after much thinking, you couldnt make sense of anything. First, Manohar was not even in the IPL GC when the contracts for the initial bids were signed. Two, ex officio members are not regular members who are supposed to check the day to day functioning of IPL. Three, what difference does it make if they have now woken up from their slumber? does that make modi's illegality condonable? Or r u suggesting that other GC members have to accept accountability as well? So u have an objection for the mess being cleaned up, just because u think its late?

now please let this idiot to look at your arguments...

First, Manohar was not even in the IPL GC when the contracts for the initial bids were signed.

BCCI is the parent body of IPL... and though the person will come and go there will always be officials who will sign... look after the deals and that is why IPL GC was formed... and when those deals were signed what GC was doing...? and why not the voices were raised from them then... if there was this grave irregularity in signing the docs...?

Two, ex officio members are not regular members who are supposed to check the day to day functioning of IPL.

exactly... this is why we appoint 'staff' of professionals in the offices... who directly reports to these so called ex-officio members like in any organisation... isn't it...? if there was any sniff of somthing fishy why these so called ex-officio sounded alarm...?

this is like saying what difference does it make if the fire in jungle is not stopped when that was just a mere 'chingari'...

as in latest article of MJ AKBAR in which he said that scapegoats has his tenacity to leave a heir... so if the 'clean up' is supposed to be done then why leaving those who by habit are deep slumbers...?

what will happen that after this alleged 'clean up' they will again go to sleep only to be waken up by another mess...

so my dear friend... call me idiot even hundred times more if it pleases you... my point when finding scapegoat has become synonym to 'clean up'...?

The allegations against Modi is precisely that documents were signed without knowledge of the GC and moreover, that many of the signed documents were not even placed before the GC. For instance, the Sony facilitation fee agreement was never placed before the GC. Where then is the question of anyone else knowing? Its fine to stereotype 'collective responsibility', but i am shocked that common sense seems to elude most of the media on this point!

Secondly, you are wrong in saying that professional staff like Sundar Raman, the CEO, are expected to report the day to day business of the IPL to ex-officio members of the GC. They are supposed to report to the Chairman and Commissioner of IPL, not the President or VP's of BCCI. These ex-officio members are on the GC of IPL soleley because they manage the parent body and need to have representation in the GC. It is in fact a simple case of criminal liability rules in company law. If an employee or director of a subsidiary company commits fraud, the Managing Director of the parent company (who is also represented in the subsidiary company's board) or other directors are not held liable. Unless of course it can be shown that the decisions by the director of the subsidiary company were taken with the active consent of all other members. That is precisely the point in issue here. The allegation against modi is that he actively and willingly concealed all vital documents from the other members and kept them in the dark. There is a term for this in criminal law and its called breach of trust.

Thirdly, your analogy with fire in the jungle is entirely misplaced. If the fire is still on even now, would you not stop it, and instead let it continue because u think the chingaari should not have been allowed in the first place? Whats wrong in stopping the fire? This scapegoat argument beats me entirely, when it is manifestly clear that the 'scapegoat' is a fraud!

Lastly, your final argument again rests on the stereotype of 'collective responsibility'. Collective responsibility can be invoked only when collective decisions were taken. If other members were tactfully kept ignorant of fishy deals, where is the question of collective responsibility?

As an epilogue, let me just point out one important fact. There is a great distinction between collective responsibility being sought to be fixed on everyone on account of slumber. And its entirely another to fix it on account of participation in corruption. If your allegations, as they seem to be, are based on the first premise, then weight has to be given to allegations of concealment levelled against modi, since integrity and good intentions of other members are not being challenged. Unless there is at least a prima facie case of abetment in corruption by other members, this argument of collective responsibility has to fail.

I bear no great pleasure in using expletives against anyone unnecessarily. But there is some merit, i would believe, in calling a spade a spade, when stereotypes are followed blindly without cerebral exercise.

Forgot to mention one more point. How is it that documents worth billions of dollars which were in exclusive custody of Modi go missing? Isnt that a clear enough case of fraud carried out single handedly by him?

then my friend why we have governing council...? governing means the one who 'governs' on all aspect of operations and commissioner or chairman is the face for us... of THAT council...

so if council says that the documents were not placed in front of them, and keep mum for three consecutive years... then please enlighten me in simple language, what meaning should be made from this...?

this press release was issued on 23rd april... in this age when all allegations are flying thick and fast... can you sight a single example to me that this press release and hence the OFFICIAL and LEGAL stand by SONY (means once it is put their hands are tied coz even they can not deny saying it) on so called 'felicitation fees' have been refuted by either govt agency or some one from BCCI...

govt is after modi and these so called murky leaks for past 10 months... but they conveniently leak it once their minister goes... income tax department and enforcement department (ED) is after these deals like a dog on mission... and not a single arrest... no single FIR...

and all this... when a single allegation is yet to be proved by the 'law of land'...

My rejoinder: Is it really so difficult for you to see that a person will have to keep mum about certain documents if he has no knowledge about the existence of the same? Whats the big deal with three years? If the IT Dept. had taken seven years, it might still have been normal to expect the other members of the board not to speak about documents they do not know exist in the first place! Do u expect them to imagine secret deals, fantasize about them and run around screaming 'eureka'?

My rejoinder: Lets stop being sunny deol by demanding instant justice. Law will take its course, investigation takes time, of course there is no arrest, no FIR. Its too early. It has been just a week or so. Wait for the coming few days. If its not fiar to convict someone without a trial, its also not fair to acquit someone who is actually on trial without the trial. Again in Modi's specific case, not even the inquiry against him has started yet. He has just been issued a show cause notice. Let him reply to the allegations and then maybe u might have to revise your blog.

the document in question are the franchise documents that were signed three years ago... manhohar has categorically said about it in the link i have provided... about RR and KXIP... so if you want to believe that for three years they did not about it... go ahead and believe i have nothing more to add... but please do not ask me to believe this crap...

regarding media deals bcci is unaware of... is laughable at best... every tom dick and harry knew that IPL has signed that deal with sony in first year... later extended it... and if unless BCCI honcohes leave in cage detached from world where tweets flow like an air... they would be knowing it too...

and why i would have to change my blog...? if you believe that by modi's going from IPL all things will be hunky dory again... then again who is stopping you in believing it... ?

lets move on to next scandal then... i am sure we will be able to find another modi then...
